City Council
The role and prerogatives of the local legislature are established by the Government Emergency Ordinance no. 57/2019 on the Administrative Code, as amended.
Also, the Decision of the City Council of Oradea no. 555/29.06.2021 approves the Regulation on the approval of the Regulation of organization and functioning of the City Council of Oradea.
According to the law, the City Council of Oradea has a number of 27 local councillors, according to the provisions of art. 112 para. 1 of Government Emergency Ordinance No 57/2019 on the Administrative Code, as amended and supplemented.

In the exercise of its powers, the City Council adopts decisions of a regulatory or individual nature.
In organising the actual execution or enforcement of the law, the City Council shall also adopt or conclude, as the case may be, other legal acts by which rights and obligations are created, modified or extinguished.
Types of meetings:
Regular meetings at least once a month, at the call of the Mayor.
Extraordinary meetings when convened:
- a) the mayor;
- b) at least one third of the number of local councillors in office;
- c) the mayor, following a request from the prefect, in cases requiring immediate action to manage crisis or emergency situations.
In case of force majeure and/or extreme urgency to resolve the interests of the inhabitants of the Municipality of Oradea or in other situations established by the rules of organization and functioning of the local council, its convocation for an extraordinary meeting, by exception to the provisions of paragraph. (3) lit. (b), shall be made immediately.
The Chairperson shall have the following main duties:
- a) chair the meetings of the local council;
- b) submits the draft resolutions to the vote of the local councillors and announces the result of the vote, specifying the votes in favour, the votes against and the abstentions counted and highlighted by the Secretary General of the Municipality of Oradea in the minutes of the meeting;
- c) sign the minutes of the meeting;
- (d) ensure the maintenance of law and order, in accordance with these Rules;
- e) submit to a vote of the local councillors any matter falling within the competence of the local council;
- f) apply, where appropriate, the sanctions provided for in Article 70 para. (1) of this Regulation or propose to the local council the application of such sanctions, as appropriate;
- g) may order the suspension of the meeting until the climate of disciplinary order in the meeting is restored;
- h) sign the minutes of the numbering and sealing of the documents that have been discussed in the meeting;
- i) performs other duties as provided by law, by these regulations or other assignments given by the City Council.
The City Council ensures, according to its competence and in accordance with the law, the necessary framework for the provision of public services of local interest concerning:
- a) education;
- b) social services for the protection of children, the disabled, the elderly, the family and other persons or groups in social need;
- (c) health;
- d) culture;
- e) youth;
- f) sport;
- g) public order;
- h) emergency situations;
- i) environmental protection and restoration;
- j) conservation, restoration and enhancement of historical and architectural monuments, parks, public gardens and nature reserves;
- k) urban development;
- l) the register of persons;
- m) bridges and public roads;
- n) community utilities of local interest;
- o) emergency services such as mountain rescue, lifeguard and first aid;
- p) social-community administration activities;
- q) social housing and other housing units owned or managed by the administrative-territorial unit;
- r) the enhancement, in the interest of the local community, of the natural resources within the administrative-territorial unit;
- s) other public services of local interest established by law.
The local council has the initiative and decides, under the law, on all matters of local interest, except those which are given by law to other local or central government authorities.
The City Council exercises the following categories of powers:
- a) powers relating to the administrative-territorial unit, its own organisation, as well as the organisation and functioning of the mayor's specialised apparatus, of public institutions of local interest and of companies and autonomous local-interest companies;
- b) tasks related to the economic, social and environmental development of the municipality;
- c) tasks related to the administration of the public and private property of the municipality;
- d) tasks relating to the management of services of local interest;
- (e) tasks relating to internal and external interinstitutional cooperation.
In exercising its powers, the City Council:
- a) approves the municipality's statute, as well as the rules of organisation and functioning of the local council;
- b) elects deputy mayors from among local councillors, on the proposal of the mayor or local councillors, under the conditions of Article 9 para. (2) of this Regulation;
- c) approves, in accordance with the law, on the proposal of the Mayor, the establishment, organization and the state of functions of the specialized apparatus of the Mayor, of the public institutions of local interest, the reorganization and the state of functions of the autonomous local interest companies, as well as the establishment, reorganization or dissolution of local interest companies and their state of functions;
- d) exercise, on behalf of the Municipality of Oradea, all the rights and obligations corresponding to the participations held in companies or autonomous companies, under the law;
- e) decides on the establishment or reorganization of institutions, public services, companies and autonomous corporations, under the terms of the law.
- a) approves, on the proposal of the Mayor, the budget of the administrative-territorial unit, the transfers of appropriations, the use of the budgetary reserve and the closing account of the budgetary year;
- b) approves, on the proposal of the Mayor, the contracting and/or guaranteeing of loans, as well as the contracting of local public debt through the issuance of securities, on behalf of the administrative-territorial unit, in accordance with the law;
- c) establishes and approves local taxes and fees, in accordance with the law;
- d) approves, at the proposal of the mayor, the technical-economic documentation for investment works of local interest, under the conditions of the law;
- e) approves the strategies for the economic, social and environmental development of the administrative-territorial unit;
- f) ensure a favourable environment for the establishment and/or development of businesses, including by exploiting existing assets and making new investments that contribute to the fulfilment of regional and local economic development programmes;
- g) ensures the execution of the works and takes the necessary measures to implement and comply with the commitments undertaken by Romania as a member state of the European Union in the field of environmental protection and water management for the services provided to citizens.
If the budget of the administrative-territorial unit, provided for in paragraph 1, is not available, the budget of the administrative-territorial unit shall be reduced. (4) lit. a), cannot be adopted after two consecutive sittings, which take place at an interval of not more than 7 days, the work shall be carried out on the basis of the previous year's budget until the adoption of the new budget, but not later than 45 days from the date of publication of the state budget law in the Official Gazette of Romania, Part I.
Other powers of the City Council:
- a) decides on the administration, concession, lease or free use of public property of the municipality, as well as public services of local interest, under the terms of the law;
- b) decides on the sale, the administration, the concession, the free use or the rental of the private property of the municipality, under the conditions of the law;
- c) endorses or approves, in accordance with the law, the territorial and urban planning documents of the localities;
- d) assign or change, under the law, the names of streets, squares and any other objectives of local public interest.
- a) supports, under the law, the activity of religious cults;
- b) approves the construction of social housing, the criteria for the allocation of social housing and housing utilities owned or managed by it;
- c) decides, under the conditions of the law, on cooperation or association with Romanian or foreign legal entities, in order to jointly finance and carry out actions, works, services or projects of local public interest;
- d) decides, under the law, the twinning of the municipality with administrative-territorial units of other countries;
- e) decides, under the law, on cooperation or association with other administrative-territorial units in the country or abroad, as well as membership of national and international associations of local government authorities, in order to promote common interests.
- f) may provide, in whole or in part, with the consent of the owner or the manager, the works and funds necessary for the rehabilitation, equipping and operation of buildings in which public authorities or institutions whose activity is of local interest carry out their activity. Assets purchased for equipment remain the property of the administrative-territorial unit;
- g) may provide, in whole or in part, with the consent of the institution or public authority holding the right of ownership or management, works of arrangement, equipment and maintenance of buildings or land in public or private property of the State, in order to increase the level of tourist attractiveness of the administrative-territorial unit, provided that, by express agreement, the right holder allows public access to the premises thus improved for a period of at least 5 years. Assets purchased for equipment remain the property of the administrative-territorial unit;
- h) The City Council may request information and reports within 30 days from the Mayor, the Deputy Mayor and the heads of bodies providing public services and public utilities of local interest;
- i) The City Council decides to grant some bonuses and other facilities, according to the law, to the staff employed in the Mayor's specialized department and in the public services of local interest;
- j) The City Council may confer to Romanian or foreign individuals with special merits the title of honorary citizen of the municipality, on the basis of its own regulation. This Regulation also lays down the conditions for the withdrawal of the title conferred. This regulation may be an integral part of the statute of the administrative-territorial unit.
- k) The City Council performs any other duties, in all areas of local interest, except those expressly given to other public authorities, as well as any other duties established by law.
